SUBDIVISION AGREEMENT <br /> <br />TRACT N0. 4863, SANTA RITA INDUSTRIAL PARK, PLEASANTON <br /> ALAj~DA COUNTY, CALIFORNIA <br /> <br /> THIS AGREEMENT made and entered at Pleasanton, California <br />this 10th day of February 1982, by and between: RHEEM INVESTmeNT <br />GROUP, a California Corporation, c/o J. David Martin, 5820 <br /> <br />Stoneridge Mall Road, Suite 300, Pleasanton, California 94566, <br /> <br />(hereinafter referred to as "Subdivider"), and DEVCON DEVELOPI-~NT, <br /> <br />INC., a California Corporation, 425 Lakeside Drive, Sunnyvale, <br /> <br />California 94086 (hereinafter referred to as "Assignee") and <br />the City of Pleasanton, a municipal corporation (hereinafter <br /> <br />referred to as "City"). <br /> <br /> WHEP~AS, Subdivider has a tentative map for said tract, <br />lying within the boundaries of the City, duly approved by <br />the Planning Connnission and the City Council; and <br /> <br /> WHEREAS, all or a portion of the area of the tentative map <br />is presented as a "final map", a copy of said map is on <br />file in the office of the City Engineer, and by reference is <br />included in this agreement for all purposes as if attached <br />hereto; and <br /> <br /> WHEREAS, Subdivilder has complied with all the conditions <br />of approval of the tentative map, including entering into an <br />agreement with the City to (1) participate in financing certain <br />studies such as traffic facilities, water services, and fire <br />services and (2) agree to participate in assessment districts <br />or other funding mechanisms for certain improvements; and <br /> <br /> WHEREAS, said map and subdivision of land designates <br />streets, easements and public ways for the City, and Sub- <br />divider proposes to dedicate this land set forth in the final <br />map to the City; and <br /> <br /> WtlEREAS, as a condition precedent to accepting this offer <br />of dedication by Subdivider, City requires the improvements of <br />the public ways, installation or extension of certain City <br />services at Subdivider's expense and certain protections for <br />the City on behalf of the public; and <br /> <br />-1- <br /> <br />EXHIBIT A <br /> <br /> <br />
