CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-37 <br /> <br />RESOLUTION APPROVING CHANGE TO SUBDIVISION AGREE- <br />MENT FOR TRACT 4863 AND APPROVING MITIGATION <br />MEASURES AGREEMENT WITH RNEEM INVESTMENT GROUP <br /> <br />WHEREAS, <br /> <br />final map, improvement plans and subdivision <br />agreements for Tract 4863, Santa Rita Industrial <br />Park, were approved by the City Council on September 29, <br />1982 under the ownership of Rheem Investment <br />Group; and <br /> <br />WHEREAS, <br /> <br />the property will be acquired by Devcon Development, <br />Inc. on February 26, 1982 and the subdivision <br />improvements will be done by Devcon Development, <br />Inc.; and <br /> <br />WHEREAS, <br /> <br />in order to change the subdivision agreements to <br />include Devcon as assignee to Rheem, it is necessary <br />for the City Council to approve the change; and <br /> <br />WHEREAS, <br /> <br />Condition No. 31 of the Tentative Map approval of <br />this tract requires the developer to enter into an <br />agreement with the City agreeing to pay for its <br />appropriate share of an assessment district or <br />districts for the construction of off-site facilities <br />necessary to support the industrial build out in <br />North Pleasanton; and <br /> <br />WHEREAS, <br /> <br />at its meeting of February 9, 1982, the City <br />Council reviewed the above agreements and concluded <br />it is in the best interests of the City of Pleasanton <br />to enter into those agreements; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Approves the change to the subdivision agreement <br />for Tract 4863, to include Devcon Development, <br />Inc. as assignee to Rheem Investment Group, of copy <br />of which agreement is attached hereto as Exhibit A <br />and incorporated herein by this reference. <br /> <br />Section 2: <br /> <br /> Approves the mitigation measures agreement <br />between the City of Pleasanton and Rheem Investment <br />Group, a copy of which is attached hereto as Exhibit <br />B and incorporated herein by this reference. <br /> <br />Section 3: Authorizes the appropriate city officials to <br /> execute the above-referenced agreements. <br /> <br /> <br />
