CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-37 RESOLUTION APPROVING CHANGE TO SUBDIVISION AGREE- MENT FOR TRACT 4863 AND APPROVING MITIGATION MEASURES AGREEMENT WITH RNEEM INVESTMENT GROUP WHEREAS, final map, improvement plans and subdivision agreements for Tract 4863, Santa Rita Industrial Park, were approved by the City Council on September 29, 1982 under the ownership of Rheem Investment Group; and WHEREAS, the property will be acquired by Devcon Development, Inc. on February 26, 1982 and the subdivision improvements will be done by Devcon Development, Inc.; and WHEREAS, in order to change the subdivision agreements to include Devcon as assignee to Rheem, it is necessary for the City Council to approve the change; and WHEREAS, Condition No. 31 of the Tentative Map approval of this tract requires the developer to enter into an agreement with the City agreeing to pay for its appropriate share of an assessment district or districts for the construction of off-site facilities necessary to support the industrial build out in North Pleasanton; and WHEREAS, at its meeting of February 9, 1982, the City Council reviewed the above agreements and concluded it is in the best interests of the City of Pleasanton to enter into those agreements; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the change to the subdivision agreement for Tract 4863, to include Devcon Development, Inc. as assignee to Rheem Investment Group, of copy of which agreement is attached hereto as Exhibit A and incorporated herein by this reference. Section 2: Approves the mitigation measures agreement between the City of Pleasanton and Rheem Investment Group, a copy of which is attached hereto as Exhibit B and incorporated herein by this reference. Section 3: Authorizes the appropriate city officials to execute the above-referenced agreements.
