CITY COUNCIL OF TIlE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-25 <br /> <br />RESOLUTION ADOPTING TIE VOTE PROCEDURE FOR THE <br />APRIL 1982 MUNICIPAL ELECTION <br /> <br />WHEREAS, <br /> <br />it is necessary for the City Council to adopt a <br />procedure for breaking tie votes should two or <br />more candidates receive an equal and the highest <br />number of votes for city council; and <br /> <br />WHEREAS, <br /> <br />Section 20501 of the Election Code provides for <br />the adoption of either of the following two tie <br />breaking mechanisms: <br /> <br />a. Deter~.ination by lot, or <br /> <br />b. Special runoff election; and <br /> <br />WHEREAS, <br /> <br />breaking a tie vote by lot is the responsibility <br />of the City Council sitting as the election board; <br />and <br /> <br />WHEREAS, a special runoff election, if held, would be <br /> consolidated with the June 1982 primary election. <br /> <br />NOW, THEREFORE, TIlE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The tie breaking procedure adopted by the City <br /> Council of the City of Pleasanton shall be "deter- <br /> mination by lot." <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JANUARY 26, 1982 BY THE FOLLOWING <br />VOTE <br /> <br />AYES <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers <br />Mercer <br />None <br />Councilmember Kephart <br />None <br /> <br />Butler, Mohr, Wood and Mayor <br /> <br />ATTEST: <br /> <br /> Y g , P Y Y <br /> <br /> <br />
