CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-21 <br /> <br />RESOLUTION APPROVING THE SETTLEMENT OF THE CASE OF <br />CITY OF PLEASANTON VS. BETSCHART <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton filed a complaint in eminent <br />domain, Action No. H-76889-4, in order to acquire <br />property necessary for the construction of Peters <br />Avenue; and <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton and the defendants, Mr. and <br />Mrs. Betschart, have negotiated a settlement of <br />that action for the total sum of $127,338.50. <br /> <br />WHEREAS, <br /> <br />at its meeting of January 12, 1982, the City <br />Council received a report from the City Attorney <br />outlining in detail the terms of the settlement of <br />this action. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes the settlement of the Alameda Superior <br /> Court Action No. H-76889-4, City of Pleasanton vs. <br /> Betschart, for the total sum of $127,338.50. <br /> <br />Section 2: Authorizes the Mayor to execute the Settlement <br /> Agreement regarding this matter and the appropriate <br /> city officials are authorized to take whatever <br /> action necessary to conclude this litigation. <br /> <br />Section 3: This resolution shall become effective irr~nediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JANUARY 12, 1982 BY THE FOLLOWING <br />VOTE <br /> <br />AYES Councilmembers <br /> Mayor Mercer <br />NOES None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Butler, <br /> <br />ATTEST: <br /> <br />By Doris George, Deputy City Clerk <br /> <br />Kephart, Mohr, Wood and <br /> <br /> KENNETH R.
