Section <br />22.1 <br /> <br />22.2 <br /> <br />22. Grievances <br /> <br />A grievance is any dispute which involves the interpre- <br />tation or application of any provision of this Memorandum <br />of Understanding excluding, however, those provisions of <br />this Memorandum of Understanding which specifically provide <br />that the decision of any City official shall be final, the <br />interpretation or application of those provisions not <br />being subject to the grievance procedure. <br /> <br />Grievances shall be processed in the following manner: <br /> <br />(1) <br /> <br />Any employee who believes that he/she has a grievance <br />may discuss his/her complaint with such management <br />official in the department in which he/she works as <br />the department head may designate. If the issue is <br />not resolved within the department, or if the employee <br />elects to submit his/her grievance directly to the <br />Union, the procedures hereinafter specified may be <br />invoked.. <br /> <br />(2) <br /> <br />Any employee or any official of the Union may notify <br />the Personnel Officer in writing that a grievance <br />exists, stating the particulars of the grievance, <br />citing the specific section of this Memorandum of <br />Understanding he/she believes to have been violated, <br />and, if possible, the nature of the determination <br />desired. The Personnel Officer shall have fourteen <br />(i4) days in which to' investigate the issues, me~t <br />with the complainant and attempt to reach a satis- <br />factory resolution of the problem. No grievance may <br />be processed under paragraphs (3) and (4) below <br />which has not first been filed and investigated in <br />accordance with this paragraph (2). <br /> <br />(3) <br /> <br />Any grievance which has not been resolved by the pro- <br />cedures hereinabove set forth may be referred to the <br />City Manager by the complainant or by the Personnel <br />Officer. Such referral shall be in writing, detailing <br />the specific issues involved in the referral, citing <br />the specific section of the Memorandum of Understanding <br />he/she believes violated, together with a statement of <br />the resolution desired. The City Manager shall <br />designate a personal representative who shall not <br />be the Personnel Officer to investigate the merits of <br />the complaint, to meet with the complainant and, if <br />the complainant is not the Union, to meet also with <br />the officials of the Union, and attempt to settle <br />the grievance. <br /> <br />-23- <br /> <br /> <br />
