CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-135 <br /> <br />RESOLUTION OF INTENTION TO VACATE A PORTION <br />OF ROADWAY AND SETTING A PUBLIC HEARING <br /> <br />WHEREAS, <br /> <br />in connection with the development of Tract 4401, <br />Stanley Commercial Park, Unit 3, Mr. Frank Auf <br />der Maur dedicated to the City of Pleasanton <br />p~rcels of land to be used for street purposes; <br />and <br /> <br />WIIEREAS, <br /> <br />a parcel dedicated for street purposes and identified <br />as Parcel B on the map of Tract 4401, as shown <br />in the attached Exhibit A, appears unnecessary for <br />present or prospective public street use; and <br /> <br />WHEREAS, <br /> <br />the Alameda County Flood Control and Water Conser- <br />vation District recently requested Mr. Auf der Maur <br />to deed the parcel of land identified as Parcel B to <br />them for flood control purposes; and <br /> <br />WHEREAS, <br /> <br />before this can be done, it is necessary for the <br />City to vacate that portion of land pursuant to the <br />requirements of Section 8320 et seq. of the Streets <br />and Highways Code of California; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section l:Pursuant to Section 8320 et seq. of the Streets <br /> and Highways Code of California, the City Council <br /> hereby declares its intention to vacate a portion <br /> of the right-of-way of the Del Valle Parkway <br /> unnecessary for present or prospective public use, <br /> said portion being a0.47acre parcel lying along <br /> the southerly right-of-way between the roadway <br /> and Arroyo del Valle near the intersection of <br /> Wyoming Street and Del Valle Parkway, as shown on <br /> the attached Exhibit A, incorporated herein by <br /> reference, and more particularly described as <br /> Parcel B of Tract 4401, on file in the Engineering <br /> Division of the City of Pleasanton. <br /> <br />Section 2: <br /> <br /> A public hearing shall be held on May 25, 1982, <br />at 8:00 p.m. in the City Council Chambers at 200 <br />Bernal Avenue, Pleasanton, California at which time <br />public testimony will be taken with regard to the <br />City's intention to vacate the portion of roadway <br />above-described. <br /> <br /> <br />
