CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAFZDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-177 <br /> <br />RESOLUTION APPROVING AGREEMENT WITH PONDEROSA <br />HOMES RE HANSEN-MIX PROPERTY <br /> <br />WHEREAS, <br /> <br />on November 22, 1971, the City of Pleasanton <br />entered into an agreement with Ponderosa Homes, <br />Howard Hansen, and Ann Marie Mix concerning the <br />phasing of development of the Hansen-Mix property; <br />and <br /> <br />WHEREAS, <br /> <br />in 1981, the City approved an amendment to the <br />1971 agreement terminating its effect on the first <br />phase of Ponderosa Homes' Country Fair project; <br />and <br /> <br />WHEREAS, <br /> <br />Ponderosa is now asking for a <br />terminate the agreement as to <br />project, lots 1-72, inclusive, <br /> <br />similar amendment to <br />the balance of that <br />of Tract 4738; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section <br /> <br />1: Approves the Agreement with Ponderosa Homes <br /> terminating a portion of the November 22, 1971 <br /> agreement regarding the Hansen-Mix property. <br /> <br />Section 2: Authorizes the mayor to execute the agreement. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br />THIS RESOLUTION ADOPTED MAY 25, 1982 BY T~ FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />Councilmembers - Brandes, Mercer, Mohr, Wood and <br /> <br /> ~yor Butler <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />ATTE ST: ROBE~E~ <br />B D G D <br /> y oris eorge, eputy City Clerk <br /> <br />APPROVED AS TO FOPS{: <br />Bri W S City Attorney <br /> <br /> <br />
