CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA P~SOLUTION N0.82-167 RESOLUTION VACATING A PORTION OF DEL VALLE PARKWAY AND AUTHORIZING EXECUTION OF DEED WHEREAS, on April 27, 1982, the City Council received a staff report recommending the vacation of a portion of the Del Valle Parkway in Tract 4401, described as Parcel B in the attached Exhibit A which is incorporated herein by this reference; and WHEREAS, on April 27, 1982, Council adopted a resolution of intention to vacate the street; and WHEREAS, the appropriate notice was given pursuant to Streets and Highways Code, Section 8300, et seq.; and ~,~IEREAS, a public hearing was held at which time the public was given the opportunity to comment on the proposed vacation of a portion of Del Valle Parkway; and WttEP~AS, the City Council determines that Parcel B of Tract 4401 is unnecessary for present or prospective public use; and WHEREAS, the City Council finds that Parcel B was dedicated for street purposes as part of Tract 4401 by Mr. Frank Auf der Maur and that in vacating the property Mr. Auf der Maur should receive title to the property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: That the portion of Del Valle Parkway shown as Parcel B of Tract 4401, described in more detail on Exhibit A attached hereto and incorporated herein by this reference is hereby vacated. Section 2: That the Director of Public Works and Utilities is directed to convey Parcel B to Mr. Frank Auf der Maur. Section 3: Authorizes the mayor to execute a deed from the City of Pleasanton to Mr. Frank Auf der Maur for the above-described property.
