CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-162 <br /> <br />RESOLUTION DIRECTING CITY ATTOP~]EY TO FILE LAWSUIT <br />AGAINST ALA2-~DA COUNTY P~ SANTA RITA JAIL FACILITY <br /> <br />WtIEREAS, Alameda County plans to construct a new wing at <br /> their Santa Rita Jail facility; and <br /> <br />~IEREAS, <br /> <br />relevant to that project, Alameda County circulated <br />a proposed negative declaration for that project <br />to the City of Pleasanton for comment; and <br /> <br />WttEREAS , <br /> <br />upon review of the Initial Study, the City Council <br />has determined that an Environmental Impact Report <br />should be prepared for the project due to the <br />significant public controversy surrounding the <br />potential environmental effects of the project, <br />and has forwarded this opinion to Alameda County; <br />and <br /> <br />WIlEREAS, <br /> <br />it has come to the attention of the Council that <br />the Alameda County Board of Supervisors have <br />proceeded to grant preliminary approval of the <br />project without having prepared an EIR; <br /> <br />NOW, THEREFORE, TIlE CITY COUNCIL OF TItE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Instructs the City Attorney to investigate the <br /> action by the Alameda County Board of Supervisors <br /> to determine if the requirements of the California <br /> Environmental Quality Act have been properly met. <br /> <br />Section 2: Directs the City Attorney to prepare to file <br /> suit against Alameda County if, after his review, <br /> the City Attorney finds that the Alameda County <br /> Board of Supervisors did indeed take action concerning <br /> the proposed Santa Rita jail facility without <br /> preparing an Environmental Impact Report. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED MAY 11, 1982 BY THE FOLLOWING VOTE: <br /> <br /> <br />
