CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFOP~IIA PZSOLUTION NO. 82-195 RESOLUTION APPROVING SETTLEmeNT OF CITY vs. FRO~i, et al., AUTHORIZING SIGNATUP~ OF SETTLE~%NT AGREEmeNT AND ACCEPTING GP~NT OF EASE}~NT AND GPj~]T DEED V~!EREAS , the City of Pleasanton filed a complaint in eminent domain, Action ~]o. ti-55399-3, in order to acquire property necessary for a sewer outfall easement, pump station, and temporary construction site; and WHEREAS, the City and defendants have negotiated a settlement of that action for the total sum of $9,562.50; and V~IEREAS, pursuant to the settlement agreement, defendants have agreed to execute a Grant Deed and Grant of Easement giving title to the property to the City of Pleasanton; and ~EREAS, at its meeting of June 8, 1982, the City Council received a report from the City Attorney outlining in detail the terms of the settlement of this action; NOW, TttEP~FORE, THE CITY COUNCIL OF TIlE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the settlement of the Alameda County Superior Court Action No. ti-55399-3, City of Pleasanton vs. From, et al., for the total sum of $9,562.50. Section 2: Authorizes the mayor to execute the Settlement Agreement regarding this matter and the appropriate city officials are authorized to take whatever action is necessary to conclude this litigation. Section 3: The Grant of Easement and Grant Deed from Alfred Fron~n, Transamerica Title Insurance Company, Carolyn Fromm, David From~, Barbara From~, Peter K. I~aier and Irving Loube to the City of Pleasanton are hereby accepted and the appropriate city officials are instructed to take whatever action is necessary to implement said acceptance. Section 4: This resolution shall become effective immediately upon its passage and adoption.
