CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALA~.~ZDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-194 <br /> <br />RESOLUTION APPROVING SETTLEmeNT OF CITY vs. PICA, <br />AUTHORIZING SIGNATURE OF SETTLE}~NT AGREEmeNT AND <br />ACCEPTING DEED <br /> <br />~iEREAS , <br /> <br />the City of Pleasanton filed a complaint in eminent <br />domain, Action No. H-76890-0, in order to acquire <br />property necessary for the construction of Peters <br />Avenue; and <br /> <br />~IEP~AS, <br /> <br />the City of Pleasanton and the defendants, Rosemary <br />Gallagher and Joan Acuff, have negotiated a settlement <br />of that action for the total sum of $141,000.00; <br />and <br /> <br />WHEREAS, <br /> <br />pursuant to the settlement agreement, defendants <br />have agreed to execute a Grant Deed giving title <br />to the property to the City of Pleasanton; and <br /> <br />I'~HEREAS, <br /> <br />at its meeting of June 8, 1982, the City Council <br />received a report from the City Attorney outlining <br />in detail the terms of the settlement of this <br />action; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the settlement of the Alameda County <br /> Superior Court Action No. H-76890-0, City of <br /> Pleasanton vs. Ruth Pica, Executrix of the Estate <br /> of Emile Narcisi, et al., for the total sum of <br /> $141,000.00. <br /> <br />Section 2: Authorizes the mayor to execute the Settlement <br /> Agreement regarding this matter and authorizes the <br /> appropriate city officials to take whatever <br /> action is necessary to conclude this litigation. <br /> <br />Section 3: The Grant Deed from Rosemary Gallagher and Joan <br /> Acuff to the City of Pleasanton is hereby accepted <br /> and the appropriate city officials are instructed <br /> to take whatever action necessary to implement <br /> said acceptance. <br /> <br /> <br />
