those identified as short and long-term improvements <br />identified in the above-mentioned study and as deemed <br />necessary by the City Engineer. In the event the subject <br />property is determined to be within the area assessed <br />for North Pleasanton water facility improvements, Developer <br />agrees to either include the subject property within <br />an assessment district or other financing mechanism, <br />subject to a maximum obligation of $5,000.00 per acre. <br />Developer may satisfy the above requirement by allocating <br />the total cost assessed against the property to individual <br />units and by collecting tbis in the manner indicated in <br />subsection ~B above. In the event dwelling units have <br />been finalled and/or sold prior to the determination of <br />the actual amount of Developer's water service facility <br />assessment and Developer elects to pay the assessment as <br />units are finalled or sold, Developer agrees to pay <br />to City within thirty (30) days of the time of the <br />assessment an amount representing the sum of each of the <br />finalled or sold units' shares as determined above. <br /> <br />D.
