VIII. WorkerslCompensation <br /> <br /> Appraisers, by executing this agreement, certify.that <br />Appraisers will comply with the provisions of Section 3700 <br />et seq. of the Labor Code of the State of California requiring <br />every employer to be insured against liability for Workers' <br />Compensation or to undertake self-insurance. Appraisers <br />shall deliver to City proof of'compliance upon executing <br />this agreement. <br /> <br /> IX. Independent Contractor <br /> <br /> Appraisers shall be'an independent contractor and aI1 <br /> <br /> persons working for and under the direction of Appraisers <br /> are their agents, servants, and employees, and not agents, <br /> servants or employees of City. <br /> <br />X. Reliance Upon Professional Skills <br /> <br /> It is mutually agreed by the parties that City is <br /> <br />relying upon the professional skill of Appraisers, and <br />Appraisers represent to City that their work will.conform to <br />the professional standards normally exercised by appraisers <br />in the State of California. The acceptance of its work by <br />City does not operate as a release of Appraisers from said <br />representation. <br /> <br />XI. Costs and Attorney's Fees <br /> <br /> The prevailing party in any action brought to enforce <br /> <br /> or ~onstrue the terms of this agreement may recover from the <br /> other party its reasonable costs and attorney's fees. <br /> <br />-5- <br /> <br /> <br />
