claim against the City as a result of City's <br />PUD conditions, whether they be for damages, <br /> <br />enforcing said <br />for mandating <br /> <br />or for any other relief. Developer further agrees that, in <br />the event an assessment district or districts are placed on <br />the project site, Developer shall have no claim against the <br />City seeking relief from assessment district obligations or <br />refunds for pa}~ents made pursuant to assessment district <br />obligations in the event develdpment is delayed or stopped <br />by Cit'y due to conditions of the PUD not being met or by <br />events beyond the control of the City. <br />VIII. DEVELOPER'S RIGHTS <br /> <br /> With reference to each of the agreements contained <br />herein to place the project site into one or more assessment <br />districts, benefit districts, or other district or funding <br />mechanism requiring approval of all or a majority of properties <br />so included~ the developer agrees to either (1) not protest <br />the establishment of the district or (2) to affirmatively <br />vote for the creation of the district or other mechanism, <br />depending on the manner of creation of the funding mechanism. <br />However., Developer retains the right to protest the type of <br />improvements, costs, and their allocation among various <br />proper'ties as to equitableness and reasonableness under any <br />of the above-mentioned funding mechanisms. <br /> <br /> In the event the assessment mechanism appears to impose <br />economically infeasible levels of cost upon the project <br />site, the City agrees to explore alternative financing <br />methods. <br /> <br /> <br />
