CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-277 <br /> <br />APPROVAL OF AGREEMENT REGARDING HOPYARD ROAD <br />IMPROVEMENTS AND ACCEPTANCE OF DEEDS <br /> <br />WHEREAS, <br /> <br />Howard Hansen and Ann Marie Mix are the owners of, <br />and Ponderosa Homes is the optionee of, an approximately <br />187 acre unimproved parcel of land located generally <br />west of Hopyard Road and northwest of Valley Avenue <br />containing 480 feet of frontage on Hopyard Road; and <br /> <br />WHEREAS, <br /> <br />Ponderosa Homes intends to exercise its option to <br />purchase and develop said land and, as its ordinary <br />obligation of development, would be responsible <br />for improving the Hopyard Road frontage; and <br /> <br />WHEREAS, <br /> <br />because the construction of ultimate improvements <br />of Hopyard Road are imminant due to development in <br />the north Pleasanton commercial/industrial areas, <br />it is necessary to complete the roadway at this <br />time; and <br /> <br />WHEREAS, <br /> <br />Ponderosa Homes has agreed to fulfill its obligation <br />to pay for Hopyard Road at a later time and Howard <br />Hansen and Ann Marie Mix have agreed to dedicate <br />the necessary right-of-way and public service <br />easement at this time so that the construction can <br />go forward; and <br /> <br />WHEREAS, <br /> <br />it is in the best interests of the City to accept <br />the deeds to allow the immediate street construction <br />and the city's interests are adequately protected <br />by entering into an agreement with Ponderosa Homes <br />to receive later payment of the costs of the <br />improvements; <br /> <br />NOW, THEREFORE, THF CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the agreement with Ponderosa Homes, Howard <br /> C. Hansen and Ann Marie Mix regarding dedications and <br /> improvements to Hopyard Road. <br /> <br />Section 2: Authorizes acceptance of the deeds for street <br /> right-of-way and public service easement from <br /> Howard C. Hansen and Ann Marie ~ix and instructs <br /> the appropriate city officers to take whatever action <br /> necessary to implement said acceptance. <br /> <br /> <br />
