CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-277 APPROVAL OF AGREEMENT REGARDING HOPYARD ROAD IMPROVEMENTS AND ACCEPTANCE OF DEEDS WHEREAS, Howard Hansen and Ann Marie Mix are the owners of, and Ponderosa Homes is the optionee of, an approximately 187 acre unimproved parcel of land located generally west of Hopyard Road and northwest of Valley Avenue containing 480 feet of frontage on Hopyard Road; and WHEREAS, Ponderosa Homes intends to exercise its option to purchase and develop said land and, as its ordinary obligation of development, would be responsible for improving the Hopyard Road frontage; and WHEREAS, because the construction of ultimate improvements of Hopyard Road are imminant due to development in the north Pleasanton commercial/industrial areas, it is necessary to complete the roadway at this time; and WHEREAS, Ponderosa Homes has agreed to fulfill its obligation to pay for Hopyard Road at a later time and Howard Hansen and Ann Marie Mix have agreed to dedicate the necessary right-of-way and public service easement at this time so that the construction can go forward; and WHEREAS, it is in the best interests of the City to accept the deeds to allow the immediate street construction and the city's interests are adequately protected by entering into an agreement with Ponderosa Homes to receive later payment of the costs of the improvements; NOW, THEREFORE, THF CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the agreement with Ponderosa Homes, Howard C. Hansen and Ann Marie Mix regarding dedications and improvements to Hopyard Road. Section 2: Authorizes acceptance of the deeds for street right-of-way and public service easement from Howard C. Hansen and Ann Marie ~ix and instructs the appropriate city officers to take whatever action necessary to implement said acceptance.
