CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-272 <br /> <br />RE: ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 82-1 <br /> <br />BE IT RESOLVED by the City Council of the City of Pleasanton as <br />follows: <br /> <br />WHEREAS, <br /> <br />by Resolution No. 82-232 a public hearing was called for <br />July 27, 1982, at the hour of 8:00 p.m. in the Council <br />Chambers, Pleasanton, California, to ascertain whether <br />the public necessity, health, safety, or welfare requires <br />the removal of poles, overhead wires and associated overhead <br />structures, and the underground installation of wires and <br />facilities for supplying electric communication, or similar <br />or associated service, within that certain area of the City <br />described as Hopyard Road from Valley Avenue to Arroyo <br />Mocho; and <br /> <br />WHEREAS, <br /> <br />notice of such hearing has been given to all affected <br />property owners as shown on the last equalized assessment <br />roll and utilities concerned in the manner and for the <br />time required by law; and <br /> <br />WHEREAS, <br /> <br />such hearing has been duly and regularly held, and all <br />persons interested have been given an opportunity to be <br />heard. <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY <br /> OF PLEASANTON hereby finds and determines that the public <br /> necessity, health, safety and welfare required the removal <br /> of poles, overhead wires and associated structures, and <br /> the underground installation of wires and facilities for <br /> supplying electric, communication, or similar or associated <br /> service on both sides of Hopyard Road from Valley Avenue <br /> to Arroyo Mocho, such described area is hereby established <br /> as Underground Utility District No. 82-1. Attached hereto, <br /> marked "Exhibit A," and hereby incorporated as part of <br /> this resolution, is a map delineating the boundaries of <br /> said District. <br /> <br />RESOLVED <br /> <br />FURTHER, that the City Council of the City of Pleasanton <br />hereby makes the following further findings with regard to <br />Underground Utility District No. 82-1: <br /> <br />The undergrounding to be accomplished pursuant to <br />this resolution will avoid or eliminate an unusually <br />heavy concentration of overhead distribution facilities. <br /> <br />The streets, roads and rights-of-way in the District <br />are extensively used by general public and carry a <br />heavy volume of pedestrian and vehicular traffic. <br /> <br /> <br />
