CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-298 <br /> <br />RESOLUTION CLARIFYING ACTION OF COUNCIL AND <br />CORRECTING ORDINANCE NO. 987 <br /> <br />WHEREAS, <br /> <br />at its meeting of August 25, 1981, the City Council <br />adopted Ordinance No. 987, approving PUD-81-7 subject <br />to certain conditions of approval; and <br /> <br />WHEREAS, <br /> <br />in approving the project, the City Council modified <br />the proposed plan and changed certain recommended <br />conditions of approval; and <br /> <br />WHEREAS, <br /> <br />when the ordinance was published and the minutes <br />of the meeting prepared, some of those modifications <br />and changes were not clearly indicated; and <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />a dispute has arisen between the developer and the <br />Planning Department regarding the correct conditions <br />attached to the development plan approval, particularly <br />as they relate to the total number of lots allowed <br />in the plan; and <br /> <br />at its meeting of August 10, 1982, the City CoUncil <br />reviewed this matter and clarified its previous actions; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLPASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The total number of lots allowed in the approval <br /> of PUD-81-7 was, in accordance with the staff <br /> recommendation for the project. <br /> <br />Section 2: Staff is directed to redraft Ordinance No. 987 <br /> making corrections to reflect Council's action in <br /> approving PUD-81-7. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED AUGUST 10, 1982 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Brandes, Mercer and Mayor Butler <br />NOES: Councilmember Wood <br /> <br /> ames R.
