LA.o,T .o. <br /> <br />DEED <br /> <br />SPACE ABOVE THIS LINE FOR RECORDER'S, USE <br /> <br />RELMIS: BO-66.27-X (C) <br /> <br /> THIS INDENTURE, made'this S~JL day of A~-~JL , 1982, <br />by and between SOUTHERN PACIFIC TRANSPORTATION COMPANY, a Delaware <br />corporation, herein termed "Railroad," and CITY OF PLEASANTON, a <br />municipal corporation of the State of California, address: 200 Bernal <br />Avenue, Pleasanton, California 94566, herein termed "Grantee"; <br /> <br />WITNESSETH: <br /> <br /> 1o That Railroad hereby grants to Grantee, subject to the <br />reservations, covenants and conditions herein contained, the right to <br />reconstruct, maintain and operate an eight (8) inch sanitary sewer <br />pipeline, hereinafter termed "structure," in, upon, along, across and <br />beneath the property and tracks of Railroad, at or near Asco <br />(Pleasanton), in the County of Alameda, State of California, crossing <br />the center line of said tracks at Engineer's Station 1483+21, Mile <br />Post BO-66.27-X, in the location shown on the print of Railroad's <br />Western Area Drawing 195888, dated June 10, 1982, attached and made a <br />part hereof. <br /> <br /> 1-a. It is understood that said structure shall be installed by <br />Devcon Construction, Inc., pursuant to a separate agreement entered <br />into with Railroad. This Indenture shall not become effective until <br />such date as Grantee accepts the said structure into its sanitary <br />sewer system.
