Prudential and CP agree to pay for the construction <br /> of Owens Drive in accordance with the Realignment <br /> Plan, including, but not limited to~ curb, gutter, <br /> sidewalk, median, paving, street lighting, traffic <br /> control devices,landscaping and utilities. <br /> <br />3.6. Prudential and CP agree to pay for the construction <br /> of replacement improvements for the Chevron service <br /> station, Harris Professional Center, and Denny's <br /> and Hungry Hunter restaurants in accordance with <br /> the Realignment Plan, including construction of <br /> replacement parking areas to City standards and <br /> replacing/improving landscaping. <br /> <br />3.7. All expenses incurred by Prudential and CP for <br /> work done pursuant to subsections 3.3, 3.4,' 3.5 <br /> and 3.6 ~hall be in an amount not to exceed a <br /> total mutually agreed upon by the City Engineer, <br /> Prudential, and CP. All such expenses shall be <br /> deemed expenses for improvements contemplated as <br /> part of, the NPAD and, if such improvements are <br /> included in the NPAD, Prudential and CP shall be <br /> <br />reimbursed therefor, <br />NPAD.
