CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAi,~EDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-328 <br /> <br />A P~SOLUTION GRANTING AUTt!ORITY TO THE CITY <br />MANAGER TO EXECUTE A~I AGREE}~NT FOR REALIGI~NT <br />OF JO}~SON DRIVE <br /> <br />WttEREAS, <br /> <br />the City of Pleasanton ("City") and Reynolds and <br />Brown, The Prudential Insurance Company of America <br />and Callahan-Pentz Properties, Pleasanton ("Developers") <br />have agreed to a Realignment Plan revising the <br />intersection configuration at Johnson Drive and <br />Hopyard Road and revising the circulation plan for <br />Pleasanton Park more particularly defined in the <br />attached Memorandum of Intent re: Johnson Drive <br />Relocation; and <br /> <br />WHEREAS, <br /> <br />Developers desire to further define their rights <br />and obligations between themselves and to enter <br />into a formal written agreement with City embodying <br />usual contract terms; and <br /> <br />~tEREAS, <br /> <br />the City's obligations will not be materially changed <br />in such agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEAS~ITOr] <br />P~SOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The City Manager is authorized to execute, on <br />behalf of the City, an agreement consistent with <br />the City's obligations contained in the ~%emorandum <br />of Intent re: Johnson Drive Relocation. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />TItIS RESOLUTION ADOPTED AUGUST 24, 1982 BY TIlE FOLLOWING VOTE: <br /> <br />AYES Councilmembers - Brandes, Mercer, ~ohr, Wood and <br /> Mayor Butler <br />~IOES None <br />ABSENT: None <br /> <br />By Doris George, Deputy City Clerk <br /> <br /> <br />
