LONG-TERM AGKEE~ENT <br /> <br /> TtlIS LONG-TERMAGREE~NT is made and entered into on <br /> <br />the 24th day of August, 1982, by and between MORRISON HO~S <br />(hereinafter referred to'as "Developer") and the CITY OF <br />PLEASANTON, a municipal corporation, (hereinafter referred <br /> <br />to as "City"). The Developer and City agree as set forth <br />below. <br /> <br /> WITNESSETH: <br /> <br /> I,~EREAS, Developer is the owner of real property in the <br />City of Pleasanton described in Exhibit A, attached to this <br />agreement and made a part of it by referenQe, which consists <br />generally of 66 acres located between Santa Rita Road and the <br />Southern Pacific railroad tracks inm~ediately north of Valley <br />Avenue; and <br /> <br /> ~tEP~AS, Developer is seeking growth management approval <br />for the Project under the City's Growth Management Program; <br />and <br /> <br /> WHEREAS, City may enter long-term'agreements with . <br />project developers meeting the requirements for such agreements <br />pursuant to Ordinance N0. 1023 (Growth Management Program) <br />and the implementing procedures contained in Resolution No. <br />82-66; and <br /> <br /> I~EREAS, City and Developer ~ish to enter into a long- <br /> term agreement in order to achieve the benefits of'the <br /> <br />Project to City and its residents while maintaining conformity <br />with the City's General Plan growth policies; <br /> EXHIBIT <br /> -1- <br /> <br /> <br />
