LONG-TERM AGREEMENT <br /> <br /> THIS LONG-TERMAGREEMENT is made and entered into on <br /> <br />the 24th day of August, 1982, by and between PONDEROSA <br />HOMES, a General Partnership, (hereinafter referred to as <br />"Developer"), and the CITY OF PLEASANTON, a municipal corporation, <br />(hereinafter referred to as "City"). The Developer and City <br />agree as set forth below. <br /> <br /> WITNESSETH: <br /> <br /> WHEREAS, Developer is the optionee of real property in <br /> <br />the City of Pleasanton described in Exhibit A, attached to <br />this agreement and made a part of it by reference, which <br />consists generally of 187 acres located westerly of the <br />intersection of Valley Avenue and Hopyard Roads; and <br /> <br /> WHEREAS, Developer's option agreement provides for a <br /> <br />series of options that may extend over a period of several <br />years; and <br /> <br /> WHEP~EAS, Developer is seeking growth management approval <br />for the Project under the City's Growth Management Program; <br />and <br /> <br /> WHEREAS, City may enter long-term agreements with <br /> <br />project developers meeting the requirements for such agreements <br />pursuant to Ordinance No. 1023 (Growth Management Program) <br />and the implementing procedures contained in Resolution No. <br />82-66; and <br /> <br />-1- <br /> <br />EXHIBIT <br /> <br /> <br />
