finance <br /> <br />any facilities <br /> <br />included in the Fire Safety Services <br /> <br />Requirements. Upon request of the then owner of any parcel <br />of ~e Property for which the obligations apportioned to <br />that parcel have been satisfied, the City shall execute in <br />recordable form any instrument ~equired to eliminate this <br />agreement as an exception to title with respect to 'that <br />parcel. <br /> <br /> 9. Subordination of Agreement. Except to the <br />extent that assessments of a Special District are superior <br />liens under California law, this agreement shall be auto- <br />matically subordinate, without the execution and recordation. <br />of any other instrument, to the lien of any deed of trust <br /> <br />or other security instrument encumbering the Property, or <br />any parcel thereof, in favor of a third party lender or <br /> <br />lenders which secures the repayment of any construction loan <br />or permanent loan, or both ("Loan"), provided that the <br />proceeds of the Loan are used only for the purchase of the <br />Property or parcel thereof or the construction of improve- <br />ments on the Property or parcel thereof, or both.
