City agrees that it shall use its good faith <br />efforts as lead agency, if possible, to secure all <br />necessary governmental approvals required by the LAV~A <br />and DSRSD expansion. City further agrees to prepare all <br />environmental documentation necessary for consideration <br />of the proposed discrete sewer plant described in <br />Paragraph i(D). Based on the environmental documentation <br />prepared, the City shall consider the construction of <br />said discrete plant, and, if approved by City, City shall <br />make good faith efforts, to the extent necessary, to <br />facilitate Owner's, or its Proposed AsSignee's, construction <br />of said discrete sewer plant. City shall, if it approves <br />such plant, serve as lead agency, if possible, and shall <br />use good faith efforts in obtaining such governmental <br />approvals as may be required to construct said plant; <br /> <br /> C. City agrees that upon Owner's, or Proposed <br />Assignee's, completion of the public improvements provided <br />for herein, at Owner's or Proposed Assignee's, sole cost <br />and expense, City shall accept the dedication by Owner, <br />or Proposed Assignee, of the land utilized for said public <br />improvements and, after a one (1) year warranty period <br />following completion of construction, shall accept ownership <br />of said improvements; <br /> <br /> D. City agrees that Owner, or its Proposed Assignee, <br />shall be reimbursed by City based on the formulas set <br />forth in Exhibit "A", Paragraphs Ill(E) and (F),attached <br />hereto,~for any allocation to third parties of the remaining <br /> <br />-9- <br /> <br /> <br />
