2.2 Contribution to Capital Fund. Caroline shall pay <br />to the City on April 15, 1981 or upon the date the "additional <br />sewer capacity" described in paragraph 2.3 hereof is constructed <br />and is available for use (whichever occurs later), cash in the <br />amount of One Hundred Thousand Dollars ($100,000.00) as a <br />contribution to the capital fund of the City. <br /> <br /> 2.3 Surcharge for Industrial Capacity and Sewer <br />Connection Fees. Caroline agrees to pay a surcharge pursuant <br />to the formula contained in Exhibit "B" to this agreement, in <br />addition to all regular sewer connection fees payable at the <br />time of connecting any structure or building to the sewer system, <br />for the portion, if any, of said"additional sewer capacity~' <br />actually used by Caroline ( or his successor) on Tract 4326. <br />The surcharge may be paid in advance to reduce carrying <br />charges, at Caroline's option. <br /> <br /> 2.4 Other Capacity. Caroline may apply for and purchase <br />se~er connections for Tract 4326 in accordance with the city's <br />standard requirements and procedures utilizing whatever current <br />sewer capacity exists until such time as the sewer capacity <br />to be created pursuant to the Willow West Agreement (500,000 GPD) <br />becomes available for use by Caroline. Upon notification of <br />the availability of that capacity, Caroline agrees not to apply <br />for or purchase any other sewer capacity beyond the allocation <br />provided in this agreement until such allocation is exhausted. <br />The limitations on the use of the 500,000 GPD capacity created <br />by the Willow West Agreement shall not apply to any regular <br /> <br />capacity purchased prior to <br />500,000 GPD. <br /> <br />the availability of the said <br /> <br />-4- <br /> <br /> <br />
