CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-363 <br /> <br />RESOLUTION DENYING REQUEST FOR A WAIVER OF A <br />PORTION OF PARK DEDICATION IN LIEU FEES FOR THE <br />VALLEY PLAZA APARTMENTS <br /> <br />WHEREAS, <br /> <br />the developers of Valley Plaza Apartments have <br />requested that a portion of their required park <br />dedication in lieu fees be waived due to the fact <br />that extensive recreational facilities are being <br />built to serve the development; and <br /> <br />WHEREAS, <br /> <br />this matter was considered by the Park and Recreation <br />Commission at its meeting of August 18, 1982 and <br />by the Planning Commission at its meeting of <br />September 8, 1982; and <br /> <br />WHEREAS, <br /> <br />it was concluded by the Park and Recreation Commission <br />that despite the facilities provided by the developer, <br />the residents of the apartment complex would still <br />be using public park facilities and therefore <br />recommended denial of the waiver of fees; and <br /> <br />WHEREAS, <br /> <br />at its meeting of September 14, 1982, Council <br />reviewed the report of the Director of Planning <br />and Community Development regarding the request <br />for waiver of fees; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the request for a waiver of a portion of <br /> park dedication in lieu fees for the Valley Plaza <br /> Apartments. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br />THIS RESOLUTION ADOPTED SEPTEMBER 14, 1982 BY THE FOLLOWING <br />VOTE <br /> <br />AYES Councilmembers Brandes, Mohr and Wood <br />NOES Councilmember Mercer and Mayor Butler <br />ABSENT: None <br />ABSTAIN: None <br /> <br />James R. ~alker, Cit~/C~lerk ~ ~~~ BUTLER, MAYOR <br />By Doris George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />PeterD.
