NILES-PLEASANTON TRACK CONSOLIDATION PROJECT <br /> <br /> agreement by each jurisdiction's respective Director of Public Works, or his <br /> designated representative. <br /> <br /> 10. That CITY agrees to defend, indemnify, hold, and save COUNTY, its <br /> officers, boards, commissions, agents, and employees harmless from any and all <br /> claims and liability for injuries to persons or damage to property caused or <br /> resulting in any manner from COUNTY's Construction activitie~ performed On behalf <br /> of CITY under the terms of this agreement, excepting for injuries tO persons or <br /> damage ~o property caused or resulting from the sole negligence or willful mis- <br /> conduct of COUNTY, its officers, boards, commissions, agents, and employees. <br /> <br /> 11. That this agreement may be amended at any time by mutual consent of <br />the parties hereto. <br /> <br /> 12.
