CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-399 <br /> <br />ACCEPTANCE OF QUITCLAIM DEED FOR SUBTERRANEAN <br />WATER AND QUITCLAIM OF CITY RIGHTS OF SURFACE <br />ENTRY FOR TRACT 4890, MORRISON HO~S <br /> <br />WHEREAS, <br /> <br />the City is in receipt of a Quitclaim Deed from <br />Morrison Homes Corp. to the City of Pleasanton for <br />subterranean waters, without rights of surface <br />entry, which is given in exchange for a Quitclaim <br />Deed from the City of Pleasanton to Morrison Homes <br />Corporation for surface entry rights and easements, <br />if any, related to the extraction of water; and <br /> <br />WHEREAS, <br /> <br />at its meeting of October 12, 1982, the City Council <br />received a report from the Director of Public <br />Works and Utilities indicating that the exchange of <br />these deeds is in the public interest; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes the Mayor to execute the Quitclaim <br /> Deed from the City of Pleasanton to Morrison Homes <br /> Corporation for surface entry rights and easements, <br /> if any, related to the extraction of water in Tract <br /> 4890. <br /> <br />Section 2: Accepts a Quitclaim Deed from Morrison Homes <br /> Corporation to the City of Pleasanton for subterranean <br /> waters, without rights of surface entry, for Tract <br /> 4890, and the appropriate city officers are instructed <br /> to take whatever action necessary to implement said <br /> acceptance. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED OCTOBER 12, 1982 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Mercer, Mohr, Wood and <br /> Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> <br />T.~.
