CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-389 <br /> <br />RESOLUTION SETTING PUBLIC HEARING TO REVIEW <br />VIACOM'S COMPLIANCE WITH FRANCHISE ORDINANCE <br /> <br />WHEREAS, <br /> <br />due to continuing problems with leakage of the <br />Escapade Channel into the homes of nonsubscribers <br />and Viacom's inability or reluctance to attempt a <br />solution to this problem, it is deemed necessary <br />by the City Council to hold a public hearing to <br />determine whether Viacom is not in compliance with <br />the terms and conditions of the Franchise Ordinance; <br />and <br /> <br />WHEREAS, <br /> <br />Section 17 of Ordinance 376 requires that the CATV <br />system be maintained in accordance with the highest <br />and best accepted standards of the industry; and <br /> <br />WHEREAS, <br /> <br />the availability of parental control boxes has not <br />been advertised as required by Section II A of the <br />September 22, 1981 agreement between the City of <br />Pleasanton and Viacom; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section <br /> <br />1: If Viacom does not voluntarily remove Escapade <br /> from its service, a public hearing is hereby <br /> scheduled for October 26, 1982 at which time <br /> Viacom is to appear and show cause why they should <br /> not be declared in default and have their award of <br /> franchise rescinded. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED SEPTEMBER 28, 1982 BY THE FOLLOWING <br />VOTE: <br /> <br />AYES Councilmembers Brandes, Mercer, Mohr, Wood and <br /> Mayor Butler <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None ~ <br />James R.
