CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-386 <br /> <br />RESOLUTION APPROVING AGREEMENT REGARDING NEW <br />WATER LINE, ACCEPTING NON-EXCLUSIVE EASEMENT <br />AND APPROVING QUITCLAIM DEED ABANDONING <br />UNNECESSARY PORTION OF 1980 WATER PIPELINE <br />EASEMENT <br /> <br />WHEREAS, <br /> <br />in 1980 a water line was constructed to provide <br />water to the sewer pump station located near the <br />1-680 and Arroyo de la Laguna intersection; and <br /> <br />WHEREAS, <br /> <br />said water line was exposed last winter and it <br />necessary to construct a new line within the <br />Hansen Ranch property; and <br /> <br />WHEREAS, <br /> <br />it is necessary to reach an agreement regarding <br />the terms and conditions for the proposed water <br />line construction, easement and abandonment of <br />previous easement; and <br /> <br />WHEREAS, <br /> <br />Council received a report outlining the terms and <br />conditions of the proposed agreement, acceptance <br />of new easement and abandonment of the unnecessary <br />portion of 1980 water pipeline easement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the agreement between Ponderosa Homes, <br /> Howard Hansen, Ann Marie Mix and the City of <br /> Pleasanton regarding the new water line, a copy of <br /> which is attached hereto and incorporated herein <br /> by this reference. <br /> <br />Section 2: Authorizes the Mayor to execute the above- <br /> described agreement. <br /> <br />Section 3: Accepts the Grant Deed from Howard Clemens <br /> Hansen and Ann Marie Mix for a non-exclusive <br /> easement for construction, operation and maintenance <br /> of a water pipeline, and the appropriate city <br /> officers are instructed to take whatever action <br /> necessary to implement said acceptance. <br /> <br />Section 4: Approves the Quitclaim Deed from the City of <br /> Pleasanton to Howard Hansen and Ann Marie Mix <br /> abandoning the unnecessary portion of the 1980 <br /> <br /> <br />
