AGREEMENT RESPECTING LETTER OF CREDIT <br /> <br /> VALLEY BUSINESS PARK ASSESSMENT DISTRICT <br /> <br /> THIS IS AN AGREEMENT between the CITY OF PLEASANTON, a <br />California general law city ("the City"), and VALLEY BUSINESS <br />ASSOCIATES and SENTE ASSOCIATES SEVEN, both general partnerships <br />("the Owner"). <br /> <br /> RECITALS <br /> <br /> A. The Owner is the developer of certain property in <br />the City commonly known as the Valley Business Park, which <br />includes thirty-six separate parcels more particularly described <br />as: Lots 12 through 30, inclusive, and 35 through 38, inclusive, <br />as shown on that certain map entitled Tract 4889, recorded <br />September 16, 1981, in Book 129 of Maps, pages 88 to 91, <br />inclusive, Official Records of Alameda County, and Lots A <br />through M, inclusive, as shown on that certain map entitled <br />Parcel Map 3860, recorded August 19, 1982 in Book 135 Of Maps, <br />pages 59 to 62, Official Records of Alameda County. <br /> <br /> B. The Owner has filed with the City a petition <br />requesting the City to take special assessment proceedings to <br />finance the cost and expense of acquiring the public <br />improvements described in the petition, and the City has <br />initiated the proceedings as Valley Business Park Assessment <br />District ("the District"). The Owner has consented to the levy <br />of special assessments upon its respective parcels, pursuant to <br />the Municipal Improvement Act of 1913 ("the 1913 Act", Sections <br />10000 and following, California Streets and Highways Code), and <br />has further consented to the issuance and delivery to Wulff, <br /> <br /> <br />
