CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION N0.82-382 <br /> <br />APPROVAL OF AGREEMENT WITH HANSEN/MIX AND PONDEROSA <br />ttOMES AND RESCINDING RESOLUTION NO. 82-277 <br /> <br />WttEREAS, <br /> <br />on July 27, 1982, the City Council approved an <br />agreement (Resolution No. 82-277) with Howard <br />ttansen, Ann Marie Mix, and Ponderosa Homes relating <br />to the grant of land and easement and provision <br />for payment of road improvements for the Hopyard <br />Road widening between Valley Avenue and the Pleasanton <br />Canal; and <br /> <br />~EREAS, subsequently, the street plan was revised to <br /> require a larger public service easement; and <br /> <br />WHEREAS, it is preferable to adopt a revised agreement <br /> rather than amend the existing agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Rescinds Resolution No. 82-277. <br /> <br />Section 2: Approves the agreement with Ponderosa Homes, <br /> Howard C. Hansen and Ann Marie Mix regarding <br /> dedications and improvements to Hopyard Road, a <br /> copy of which is attached hereto and incorporated <br /> herein by this reference. <br /> <br />Section 3: Authorizes acceptance of the deeds for street <br /> right-of-way and public service easement from <br /> Howard C. Hansen and Ann Marie Mix and instructs <br /> the appropriate city officers to take whatever <br /> action necessary to implement said acceptance. <br /> <br />Section 4: Authorizes the mayor to execute the above- <br /> described agreement. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED SEPTEMBER 28, 1982 BY THE FOLLOWING <br />VOTE: <br /> <br /> <br />
