CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION N0.82-382 APPROVAL OF AGREEMENT WITH HANSEN/MIX AND PONDEROSA ttOMES AND RESCINDING RESOLUTION NO. 82-277 WttEREAS, on July 27, 1982, the City Council approved an agreement (Resolution No. 82-277) with Howard ttansen, Ann Marie Mix, and Ponderosa Homes relating to the grant of land and easement and provision for payment of road improvements for the Hopyard Road widening between Valley Avenue and the Pleasanton Canal; and ~EREAS, subsequently, the street plan was revised to require a larger public service easement; and WHEREAS, it is preferable to adopt a revised agreement rather than amend the existing agreement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Rescinds Resolution No. 82-277. Section 2: Approves the agreement with Ponderosa Homes, Howard C. Hansen and Ann Marie Mix regarding dedications and improvements to Hopyard Road, a copy of which is attached hereto and incorporated herein by this reference. Section 3: Authorizes acceptance of the deeds for street right-of-way and public service easement from Howard C. Hansen and Ann Marie Mix and instructs the appropriate city officers to take whatever action necessary to implement said acceptance. Section 4: Authorizes the mayor to execute the above- described agreement. Section 5: This resolution shall become effective immediately upon its passage and adoption.
