Council of the City of Pleasanton has found that <br />the access easement sought to be acquired is <br />necessary for the purpose of providing access <br />to a property cut off from access to a public <br />road and that provision of said access easement <br />is reasonably necessary and appropriate taking <br />into consideration any hardship to the owner of <br />the property being subjected to said easement; <br /> <br />WHEREAS , <br /> <br />due to the need to alleviate traffic interference <br />and congestion, it is necessary and desirable for <br />the City of Pleasanton to acquire those certain <br />real property interests described in Exhibit "A"; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section <br /> <br />1: The public interest and necessity require the <br /> project and the taking of the fee simple title <br /> and/or easement for access purposes in and to <br /> those properties described in Exhibit "A" for the <br /> widening of Hopyard Road near its intersection <br /> with Johnson Drive, the realignment and widening <br /> of Johnson Drive East of Hopyard Road, and the <br /> construction of public utility facilities. <br /> <br />Section 2: The project is planned and located in the manner <br /> which will be most compatible with the greatest <br /> public good and the least private injury. <br /> <br />Section 3: The property sought to be acquired is necessary <br /> for the project. <br /> <br />Section 4: The City Attorney and the law firm of Lynch & Nave <br /> are hereby directed to institute and conduct to a <br /> conclusion an action in eminent domain for the <br /> acquisition of the estates and interests aforesaid <br /> and to take such action as is necessary therein. <br /> <br />Section 5: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED OCTOBER 12, 1982 BY THE FOLLOWING VOTE: <br /> <br /> AYES: Councilmembers - Brandes, Mercer, Y~hr, Wood and PLyor Butler <br /> NOES: None <br /> <br />~Doris George, Deputy City Clerk <br /> ~aeDonald, C~ty Attorney <br /> <br />-2- <br /> <br /> <br />
