CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-440 RESOLUTION AMENDING RESOLUTION NO. 82-66 BY ADDING SUBSECTION 3(e)(iii) TO EXHIBIT "A" NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Section 3(e) of Exhibit "A" to Resolution No. 82-66 is hereby amended by the addition of sub- section (iii) as follows: "(iii) The above growth management fees shall be payable thirty (30) days from the date of approval of the tentative map by the decision- making body. In the event no tentative map application is presented within ninety (90) days from the date of small project approval, said fees shall be payable within ninety (90) days from the date of small project approval. Failure to pay fees within the specified time will result in small project approval becoming null and void. Payment of growth management fees shall not prevent lapse of growth manage- ment approval in accordance with the ordinance and lapse of growth management approval shall not entitle developer to a refund of growth management fees." Section 2: The above amendment shall apply to those projects which apply for growth management approval after the effective date of this resolution. Section 3: It is the intent of the Council that draft long-term agreements shall, to the extent practicable, incorporate the same terms and conditions which are applied to small project approvals. Section 4: This resolution shall become effective immediately upon its passage and adoption.
