CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-429 <br /> <br />RESOLUTION AGREEING TO THE EXCHANGE OF PROPERTY <br />TAX REVENUE FOR ANNEXATION NO. 103 <br /> <br />WHEREAS, <br /> <br />Section 99 of the Revenue and Taxation Code (AB 8) <br />provides, among other things, that no local agency <br />jurisdictional change can be completed without <br />the agencies affected by such change first having <br />agreed upon an exchange of property tax revenue <br />between and among the affected agencies; and <br /> <br />WHEREAS, <br /> <br />the Alameda County Mayors' Conference, the City of <br />Pleasanton (Resolution No. 80-74) and the Alameda <br />County Board of Supervisors (Resolution No. 186574) <br />have agreed to a method for equitably distributing <br />the property taxes; and <br /> <br />~EREAS, <br /> <br />such specific annexation needs a resolution from <br />both the City and County agreeing to the exchange <br />of property tax revenues for the annexation to be <br />completed and filed with the State; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: That for Annexation No. 103 by the City of <br /> Pleasanton, which will be first effective for the <br /> fiscal year following the filing of the Certificate <br /> of Completion with the State Board of Equalization <br /> providing the filing occurs prior to December 31 <br /> of the preceding year, the Auditor-Controller of <br /> the County of Alameda shall be directed to cause <br /> an exchange of property tax revenues pursuant to <br /> the provisions of paragraphs No. 1 and 3 of the <br /> attached City/County agreement. <br /> <br />Section 2: That City certifies that: <br /> <br />There is no significant commercial and/or industrial <br />development in the proposed annexation. <br /> <br />Section 3: That the exchange of special district property <br /> taxes is limited to the special fire district F-1964. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED OCTOBER 26, 1982 BY THE FOLLOWING <br />VOTE: <br /> <br /> <br />
