SEVENTH AMENDMENT TO AGREEMENT This amendment made and entered into thls day of , 1982, by and between the CITY OF PLEASANTON (hereinafter referred to as "CITY" or "OWNER") and KENNEDY/JENKS ENGI~tERS, INC., formerly Kennedy Engineers, Inc., a California corporation (hereinafter referred to as "ENGINEER"); WITNESSETH WHEREAS, CITY and ENGfNEER entered into an Agreement dated 7 January 1974 for engineering services related to the construction of an interceptor sewer line from CITY's Sunol sewage treatment plant to the Valley Community Services District (now kno~ as the Dub]in-San Ramon Services District) sewage treatment plant; and WHEREAS, the parties bare previously entered ~nto Amendments to the 7 January 1974 Agreement in order to comply with current or changing Federal Regulatfons (First Amendment dated 9 February 1976; Second Amendment dated 11 April 1977; Third Amendment dated 15 September ].977; Fourth Amendment dated 27 November 1979); WHEREAS, the amount of work anticipated when the original Agreement and Amendments to Agreement were execut,~d changed and may be subject to additional changes in the futGre; NOW, THEREFORE, in consideration of tile terms, promises, covenants, and conditions set forth berein, the l}art[~s hereto agree to amend Amendments No. 1, 2, 3, and 4 as follows: ENGINEER'S OVERHEAD RATE MODIFICATION: Engineer's provisional overhead ratos referred tn in Amendments #1, #2, #3 and #4 shall be adjusted as follows: For all work performed in 1977: For all work t~rformed in 1978: For all work performed in 1979: For all work performed in 1980: 144.5% (was 146%) 163.93% (was 146%) 160.10% (was 146%) 149.40% (was 146%) EFFECT ON PROJECT COSTS: 1977 1978 197~ 1980 Total Additional Costs 1977 thru 1980 $ <569.74> 4,322.41 9,819.09 954.78 $14,526.54 -1-
