SIXTH AMENDMENT TO AGREEMENT This Amendment made and entered into this day of 1982, by and betweex~ the CITY OF PLEASANTON (hereinafter referred to as "CITY" or "OWNER") and KENNEDY/JENKS ENGINEERS, INC., formerly Kennedy Engineers, Inc., a California corporation (hereinafter referred to as "ENGINEER"); WITNESSETH WHEREAS, CITY and ENGINEER entered into an Agreemeat dated 7 January 1974 for engineering services related to the construction oI an interceptor sewer line from CITY's Sunol sewage treatment plant to the Valley Community Services District (now known as the Dublin-San Ramon Services District) sewage treatment plant; and WHEREAS, Paragraph fI.3 of said Agreement contemplated the per- formance by ENGfNEER of construction inspection for the project; and WHEREAS, the parties have previously entered into Amendments to the 7 January 1974 Agreement in order to comply with changing federal regulations (First Amendment, dated 9 February 1976; Second Amendment, dated 11 April 1977; Third Amendment, dated 15 September 1977; Fourth Amendment, dated 27 November 1979; Fifth Amendment, dated 10 November 1981); and WHEREAS, the amount of work anticipated when the original Agree- ment and Amendments to Agreement were executed changed and may be sub- ject to additional changes in the future; NOW, THEREFORE, in consideration of the terms, promises, cove- nants, and conditions set forth herein, the parties hereto agree to amend the Fifth Amendment of 10 November 1981 as follows: A.1 WORK TO BE PERFORMED Add the following: "w. Additional work effort to complete Step III services for the cathodic protection systems project." A-6 COST Delete entire section and add the following: "ENGINEER's work pursuant to this &nendment is based upon time and expense cost reimbursement for the additional work to complete the original scope of work as described under A.l.a tbrough A.l-w above.
