CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-445 RESOLUTION APPROVING CONNECTION TO CITY SEWER SYSTEM AND PREANNEXATION AGREEMENT WITH BILL BREWER FOR PROPERTY AT 744 MOCKINGBIRD LANE WHEREAS, due to the failure of the private sewage disposal system at 744 Mockingbird Lane, the property owner, Bill Brewer, has indicated his desire to enter into a preannexation agreement with the City in order to be connected to the City's sanitary sewer system; and WHEREAS, because of the health and safety hazard, it is in the City's best interest to authorize the con- nection to the City sewer system; and WHEREAS, due to the length of the sewer line to be con- structed and the possibility that neighbors may wish to connect to that line in the future, Mr. Brewer has requested that some form of reimburse- ment agreement be drafted; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Authorizes the connection of 744 Mockingbird Lane to the City sewer system, provided all main extension and connection work is done to the satisfaction of the City Engineer and all costs are borne by property owner. Section 2: Approves the Pre-Annexation and Provision of Sewerage Facilities and Services Agreement for future annexation and requires the property owner to enter into said agreement. Section 3: Authorizes the mayor to execute the above- described agreement, a copy of which is attached hereto. Section 4: Directs the City Attorney to prepare a reimburse- ment agreement for partial reimbursement of costs to Mr. Brewer in the event other residents connect to the sewer line constructed by Mr. Brewer and authorizes the mayor to execute said reimbursement agreement.
