disruption of Hopyard Road traffic by timing said consLruction <br />~ith the llopya~'d Read widening now under construction. <br /> <br /> Construction of the improvements on the northeastern <br />corner of the intersection require certain property acquisitions <br />in order to secure the necessary rights-of-way and other <br /> <br />interests for tile lzelocated and widened hopyard Road and <br />Johnson Drive as shown on the plats attached hereto as <br /> <br />Exhibit "A". City exercise of its power of eminent domain <br /> <br />may be required to secure the necessary rights-of-way and <br />other interests if acquisition of those lands cannot be <br /> <br />secured by other means. <br /> <br /> D. The improvements to be constructed at the intersection <br />of Hopyard Road and Johnson Drive will benefit the development <br />of Hacienda Business Park, and such improvements are contemplated <br />by the parties to be within the scope of the purpose for <br />which ~he North Pleasanton Assessment District will be <br />formed and will be a portion of the major improvements to he <br />financed by the North Pleasanton Assessment District. <br /> <br /> E. The purpose of this Agreement is to set forth the <br /> <br />understanding of the parties relating to the payment, financing, <br />and extent of the acquisition of the necessary rights-of-way <br />and other i. nterests to accomplish the construction of the <br />~mprovements in the northeast quadrant of the Hopyard Road- <br />Johnson Drive intersection improve~nonts. <br /> <br /> TIlE PARTIES HEREI-~Y Af;REE AS FOLLOWS: <br /> <br /> L.
