CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAj~EDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-524 <br /> <br />RESOLUTION MODIFYING CONDITION OF APPROVAL ON LOTS <br />16 AND 17 OF RECORDED MAP FOR TRACT 5004 <br /> <br />WtlEREAS <br /> <br />~EP~AS <br /> <br />Council approved Tract Map 5004 with certain <br />conditions attached, one of which reouired establishment <br />of a 12-foot public service easement between Lots <br />16 and 17 for access to KottinKer Park; and <br /> <br />at the time the condition was imDosed on PUD-80-13 <br />staff felt that since the cul-de-sac is approximately <br />650 feet long, Which is longer than the 500 feet <br />generally accepted, an emergency Dolice, fire, and <br />ambulance access would be desirable; and <br /> <br />~IEREAS <br /> <br />the residents on Rowell Lane have requested that <br />this public service easement be removed in the <br />interest of maintaining the privacy, security, and <br />quiet now enjoyed prior to completion of the Daved <br />easement; and <br /> <br />~tEREAS <br /> <br />in his report dated November 16, 1983, the Director <br />of Public Works and Utilities indicated his concurrence <br />with the request; and <br /> <br />I~ftEREAS <br /> <br />after a review of the report and public testimony, <br />Council makes the following findings: <br /> <br />that there are changes in circumstances which <br />make the condition of the public service <br />easement no longer appropriate or necessary; <br /> <br />that the modification does not impose any <br />additional burden on the present fee owner of <br />the property; <br /> <br />the modification does not alter any right, <br />title, or interest in the real property <br />reflected on the recorded map; and <br /> <br />finds that the mad as modified conforms to <br />the provisions of Section 66474, i.e. is <br />consistent with the City of Pleasanton General <br />Plan; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Authorizes the City Engineer to execute and <br /> record the appropriate certificate of correction, <br /> <br /> <br />
