CITY COUNCIL OF THE CITY OF PLEASANTON ALAj~EDA COUNTY, CALIFORNIA RESOLUTION NO. 83-524 RESOLUTION MODIFYING CONDITION OF APPROVAL ON LOTS 16 AND 17 OF RECORDED MAP FOR TRACT 5004 WtlEREAS ~EP~AS Council approved Tract Map 5004 with certain conditions attached, one of which reouired establishment of a 12-foot public service easement between Lots 16 and 17 for access to KottinKer Park; and at the time the condition was imDosed on PUD-80-13 staff felt that since the cul-de-sac is approximately 650 feet long, Which is longer than the 500 feet generally accepted, an emergency Dolice, fire, and ambulance access would be desirable; and ~IEREAS the residents on Rowell Lane have requested that this public service easement be removed in the interest of maintaining the privacy, security, and quiet now enjoyed prior to completion of the Daved easement; and ~tEREAS in his report dated November 16, 1983, the Director of Public Works and Utilities indicated his concurrence with the request; and I~ftEREAS after a review of the report and public testimony, Council makes the following findings: that there are changes in circumstances which make the condition of the public service easement no longer appropriate or necessary; that the modification does not impose any additional burden on the present fee owner of the property; the modification does not alter any right, title, or interest in the real property reflected on the recorded map; and finds that the mad as modified conforms to the provisions of Section 66474, i.e. is consistent with the City of Pleasanton General Plan; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Authorizes the City Engineer to execute and record the appropriate certificate of correction,
