CITY COUNCIL OF TttE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFO~]IA RESOLUTION NO. 83-510 A FiESOLUTION ACCEPTING A GRANT DEED FROM ~I~RGARET i.. SI~ONS FOR DEL VALLE PARKI.~Y WHEREAS, the City of Pleasanton has negotiated an agreement for the purchase of a portion of property owned by Margaret D. Simmons for use in the construction of Del Valle Parkway, said agreement entailing payments spread over four years as described in the addendum to the aRreement; and WHEREAS, the City of Pleasanton intends to purchase said property out of this current year's revenue; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the Real ProDerty Purchase Contract, attached hereto and incorporated herein by this reference, and authorizes the Director of Public Works to execute the Contract. Section 2: Accepts the real property described in the Contract described above and authorizes the City Manager to execute a Certif~cat~ o~ Acceptance of Real Property. Section 3: Appropriates $215~602,50, the full cost of the purchase of the DroDerty, from this year's revenue and directs staff to create a trust and a~ency account with instructions to Day ~ar~aret D. Simmons in accordance with the addendum to the Real ProDertv Purchase Contract, with any interest earned on said account to be returned to ~he City's general fund should any funds remain upon final payment under the Contract. Section 4: Authorizes and directs staff to take whatever actions are required to implement the above actions. Section 5: This resolution shall become effective immediately upon its passage and adoption.
