CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-482 APPROVAL OF EXEMPTION FROM GROWTH MANAGEMENT PROGRAM FOR VALLEY PLAZA VILLAGES II WHEREAS the developers of Valley Plaza Villages II have requested a lower income housing exemption under Section 2-20.04 of the Growth Management Ordinance for 128 units of a 154-unit multi-family project planned for the north side of Valley Avenue just west of the Valley Plaza center; and WHEREAS allocations for small projects for 1984 have been exhausted, but if the lower income housing exemption is granted for this project, 26 permits will be released for use by local builders of small projects; and WHEREAS the Director of Planning and Community Development presented his report regarding the request from Valley Plaza Villages II which analyzed the request and made several recommendations; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Approves the low income housing exemption for Valley Plaza Villages II, to be imDlemented through an agreement between the City and the developer incorporating the following four elements: Fifteen (15) year rent limitation of 32 designated units (although flexibility should be allowed over time to allow shifting in such designation). One-half (16) of the designated low income units should be two bedroom units, and one- half should be one bedroom units. Rent adjustments may be allowed annually based upon HUD income guidelines. The developer and his successors shall be responsible for yearly status reports on the administration of the lower income units within the project. Such reports will include information on occupancy and income of tenants.
