Mol]er ar,d [.loyd M. <br />Mo]]er for Constructior~ nf Foot]n]]] Reservoir <br /> <br />Honozable Mayor and Members cff the <br /> <br />Background <br /> <br />As vou are aware, the City, thrl~ugh Prudential, /~tends <br />build the roadway and pad for lhe 7or,thill Re.~erv!-,ir Drior <br />to this winter's rains in order t.o enable construction on <br />the reservoir to continue through the winter and be operational <br />some time jn late spr~ng or earl,,' summer. The p]ans and <br />specifications for this work have been approved by Council. <br />The majority of the property required for the reservoir has <br />been acquired previously pursuant ~o an agreement dated <br />February 13, 1979 with the Uoller=~. Becausu ;u: <br />gallon, rather Ehal] the origir~alLv proposed 3 million gallon, <br />reservoir is being planned, additional property js requ:lred <br />and is being sought 1,y the City fr{~m the ~id]lers. <br /> <br />Final acquisition of the property could take considt. rable <br />time (i) in order to reach agreement on value and final area <br />to be taken, and (ii) in order to enable the Mo]lers to <br />clear the property from Drobate proceedings. In order to <br />begin constructi,'-.,~ n~:~,; tfi,c Cit~. ~as st,u~4hL L~, ~,i',t,~fre a <br />right--of-entry to enable the C?,t.z ~o start work immediately. <br /> <br />Attached is a draft Right-o~.-Entr? Agreeme~t. The rigbr-I~f-entry <br />would allow the City to begjn construction nc.w up,~in the <br />enlarged site necessary for the 8 mj]]io~ gallon reservoir <br />(the p~rcel o~ed by t~e City plus area described in the <br />agreement as "Area ~FI"). It also allows the City to kme an <br />area for stockpi]h~g rnater~al rem~,~ed f~c~m the s~e for <br />later backfilling around the reservoir.
