Box 520 <br />Pleasanton, CA 94566 <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into on the llth day of <br />October, 1983, by and between SAB INVESTMENT COMPANY, a <br />California general partnership, and FOOTHILL ENTERPRISES, a <br />California general partnership, (hereinafter referred to <br />collectively as "Owner") and the CITY OF PLEAS~]T~N, a municipal <br /> <br />corporation, (hereinafter referred to as "City"). The City <br /> <br />and Owner agree as set forth below. <br /> WITNESSETtt: <br /> <br /> WHEREAS, Owner is the owner of real property in the City <br />of Pleasanton described in Exhibit "A", attached to this <br />agreement and made a part of it by reference, which consists <br />of Parcels A, B and C, as shown on Parcel Map 3701, filed <br /> <br />May 24, 1982, in Book 13 of Parcel MAPS, Pages 70-72 (hereinafter <br />referred to as the "project site"); and <br /> <br /> WHEREAS, Owner's predecessor has received approval for a <br />General Plan amendment, Resolution No. 81-186, and PUD rezoning <br />and development plan approval, Ordinance No. 1014, which would <br />allow a proposed office/commercial/residential project to be <br />developed on the above project site (hereinafter referred to <br />as the "project"); and <br /> <br /> WHEREAS, prior to aDproving the General Plan amendment, City <br />adopted a Mitigated Negative Declaration in which certain <br /> <br />-1- <br /> <br /> <br />
