If <br />Parcel C is developed for industrial or commercial uses, each <br />Sewer Permit on Parcel C shall be an entitlement to two hundred <br />eighty (280) gallons per day notwithstanding any change in computation <br />of Dwelling Unit Equivalents. <br /> <br /> (6) That the three year period for the Property <br />Sewer Permits was tolled for a period of ~11 days from April 6, <br />1981 to February 11, 1982 (the effective date of the PUD Approval) <br />because prior to February 11, 1982 the Property was zoned for <br />residential development and the City's Growth ~anagement Program <br />precluded the Owner from obtaining building permits within the <br />meaning of Paragraph 8 of Court Order Exhibit B. <br /> <br /> (7) That after adjusting for the effect of the <br />tolling described in subparagraph 7 above, as of October ll, <br />1983, the amount of the three year period remaining to obtain <br />building permits with respect to the Property Sewer Permits is <br />four hundred eighty-nine (489) days. <br /> <br /> (8) That the Owner may allocate the Property <br /> <br />Sewer Permits to improvements or <br />Property without the approval of <br />instruments acceptable to Owner, <br />shall provide City with a notice <br />such allocation. <br /> <br />subdivided portions of the <br />City, by Grant Deed or other <br />provided, however that Owner <br />of assignment in each case upon <br /> <br /> 4.
