Dwelling Unit Equivalents of sewer capacity applicable to <br />the Property, with the balance of 240 Dwelling Unit Equivalents <br />remaining applicable to Parcel C and subject to an option to <br />purchase by Mozart. <br /> <br /> D. Until February 11, 1982 the Citv's Growth Management <br />Program had the effect of toiling the three year period <br />within which the Owner of the Property and Parcel C had to <br /> <br />obtain building permits pursuant <br />(defined in Paragraph 3B below). <br />1982, City approved Ordinance No. <br /> <br />to Court Order Exhibit B <br />On or about January 12, <br /> <br /> 1014, constituting rezoning <br /> <br />of the Property from high density resideutial and open space <br />to planned unit development, commercial and offices, and <br />Parcel C from high density residential and open space to <br />planned unit development-high density residential and open <br />space ("PUD Approval"). The PUD Approval took effect <br /> <br />February 11, 1982, thereby removing the effect of the restrictions <br />imposed by the Growth Management Program with respect to the <br />three hundred eighty-seven (387) Dwelling Unit Equivalents <br />applicable to the Property, however the 240 Dwelling Unit <br />Equivalents applicable to Parcel C continue to be subject to <br />tbe Growth Management Program and sa~d three year period <br />continues to be tolled. <br /> <br /> NOW~ THEREFORE, in consideration of the mutual convertants <br />and agreements contained herein and the sum of One Thousand <br />Dollars ($1,000.00) being paid to Pleasanton as a processing <br />fee concurrently herewith, the parties do hereby agree as <br />follows: <br /> <br />--2- <br /> <br /> <br />
