S E P ~ 0 1983 <br /> <br />shall be delayed by the actual amount of delay caused by such <br />governmental action or litigation, but only with respect to the <br />Permits rendered unusable by such governmental action or litigation. <br /> <br /> B. The parties agree that the cffec~ of th~s Paragraph <br /> <br />4A is to suspend the running ~f the remain~n~ portior~ of the <br />three year period with respect to each Property Sewer Permit by <br />the period during which Owner is prevented t>v t:hi.~; D~velopment <br />Defermerit Agreement from using that Property Sewer Permit to <br />obtain a building permit. <br /> <br /> 5. Additional Sewer Restrictions. In co~lsideration for <br /> <br />the execution of this Agreement by City. the other parties to <br />this Agreement agree to the restrictions imposed by this Paragraph <br />for so long as there remain valid Propert;,~ Sewer Permits which <br />have not been allocated to improvements which are the subject of <br />building permits (whether or not such buiidings have been constructed). <br />Owner or any successor in interest to a pF~rtion of the t;roperty <br />which has been subdivided or otherwise legally divided from the <br />balance of the Property, shall not be entitled to obtain additional <br />sewer capacity from the City pursuant to its "first come, first <br />served" policy with respect to any additional sewer capacity <br />required by Owner or successor until all 387 Property Sewer <br />Permits have either expired or been allocated to jn~n:ovements <br />which are the subject of building permits (whether or not such <br />buildings have been constructed). <br /> <br /> 6.
