17. Binding on Land and Successors. All covenants, promises <br />and agreements contained in this agreement shall pertain to and do <br />hereby expressly run with the land controlled by Subdivider and <br />described herein. This agreement shall bind and inure to the parties <br />hereto, including heirs, assigns, executors, administrators, and all <br />other parties whether they succeed by operation of law or voluntary <br />acts of Subdivider.. Signatures and execution of all parties shall <br />be acknowledged before a notary public. Either party may file and <br />record this agreement with the Recorder of Alameda County. <br /> <br /> 180 Effect on Previous Aqreement. The parties agree that this <br />agreement shall be the sole subdivision agreement applicable to <br />Tract 5129, Fairlands, Unit 9, in the City of Pleasanton. The sub- <br />division agreement dated September 27, 1983 by and between First <br />Pleasanton Investors and the City of Pleasanton is hereby rescinded <br />and shall have no further force and effect upon the execution of this <br />agreement. <br /> <br /> The parties hereto affix their signatures to this agreement <br />as of the date and year first written above. <br /> <br />CITY OF PLEASANTON <br /> <br /> By <br />ATTEST: Robert E.
