17. Binding on Land and Successors. All covenants, promises and <br />agreements contained in this agreement shall pertain to and do hereby <br />expressly run with the land controlled by Subdivider and described <br />herein. This agreement shall bind and inure to the parties hereto, <br />including heirs, assigns, executors, administrators, and all other <br />parties whether they succeed by operation of law or voluntary acts of <br />Subdivider. Signatures and execution of all parties shall be acknowledged <br />before a notary public. Either party may file and record this agreement <br />with the Recorder of Alameda County. <br /> <br /> 18. Effect on Previous Agreement. The parties agree that this <br />agreement shall be the sole subdivision agreement applicable to <br />Tract 3148, Fairlands, Unit 8, in the City of Pleasanton. The sub-. <br />division agreement dated February 25, 1981 by and between Warmington <br />Development, Inc. and the City of Pleasanton is hereby~rescinded and <br />shall have no further force and effect upon the execution of this agree- <br />ment. In addition, the subdivision agreement dated June 19, 1972 between <br />Amador Valley Investors and the City of Pleasanton has no force and <br />effect upon the execution of this agreement. <br /> <br /> The parties hereto affix their signatures to this agreement <br />as of the date and year first written above. <br /> <br />CITY OF PLEAS~_NTON <br /> <br />ATTEST: <br /> <br />James R.
