CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-406 <br /> <br />RESOLUTION RELEASING LANDS WITHIN TRACT 4373 FROM <br />FURTHER ROAD IMPROVEMENT OBLIGATIONS <br /> <br />WHEREAS, <br /> <br />a Deferred Street Improvement Agreement dated <br />December 13, 1977 was entered into between the <br />City and Castlewood Enterprises which required <br />certain street improvements based upon the frontage <br />of the parcel on the street to be improved; and <br /> <br />WIIEREAS, <br /> <br />Lots C and D of Parcel Map 2293 have been resubdivided <br />by Tract 4373 which contains frontage along Foothill <br />Road subject to the above agreement; and <br /> <br />WHEREAS, <br /> <br />improvements have been made in connection with <br />Tract 4373 which are equivalent in value to those <br />street improvements required by the agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: The City Council hereby releases those lands <br /> within Tract 4373 from any further street improvement <br /> obligations contained in the Deferred Street <br /> Improvement Agreement dated December 13, 1977. <br /> <br />Section 2: The City Clerk is directed to cause this resolution <br /> to be recorded with the Recorder of Alameda County. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED SEPTEMBER 27, 1983 BY THE FOLLOWING <br />VOTE <br /> <br /> AYES Councilmembers - Brandes, Mercer, Mohr, Wood and <br /> Mayor Butler <br /> NOES None <br /> ABSENT: None <br /> <br />~B~ Doris George, Deputy City Clerk ames R.
